Land Use and Environmental

 

The firm's land use practice includes a broad range of zoning, growth management, and environmental matters. Our lawyers have handled numerous zoning and variance issues.

Our environmental practice comprises two main areas:

Client counseling on the investigation and analysis of potential environmental problems; and

Administrative and civil litigation concerning parties' obligations to remediate environmental problems.
Lawyers from the firm have appeared before the Environmental Protection Agency and the Alabama Department of Environmental Management to obtain permits, deal with contaminated properties and to provide counsel with respect to industry practices and standards. The policy of the firm is to minimize the need for litigation through careful planning and close interaction with the appropriate administrative agency personnel, an approach which works well in controlling our clients' environmental compliance costs.

Of course, it is not always possible to avoid litigation, and the firm represents clients in environmental litigation when it arises. The firm has successfully represented land owners, developers, and investors in litigation matters, including Superfund and other contaminated sites.
