Representative Cases
Workers Compensation
- Representation of several large restaurant chains for all workers' compensation claims, wrongful termination claims, and other employment related matters with numerous serious cases tried or favorably settled in mediation.
- Representation of several large insurers and third party administrators specializing in the timber industry and other high risk occupations. Favorable trials and settlements of numerous cases in counties in southwest Alabama.
- Representation of Alabama Insurance Guaranty Association in worker's compensation litigation assumed by the Alabama Insurance Guaranty Association after carriers placed in liquidation.
- Prosecution of fraudulent claimant for workers compensation fraud upon discovery of lying and deceiving doctor regarding injury. Workers compensation claim was dismissed.
Personal Injury Insurance Defense
- Representation of several personal lines and commercial vehicle insurance carriers in first party (uninsured motorists) and third party litigation, from soft tissue injuries to catastrophic and wrongful death claims.
- Representation of the driver of a tractor trailer involving a wrongful death case resulting in a jury defense verdict. Represented the driver of a motor vehicle in a collision with a motorcycle resulting in a jury defense verdict.
Commercial General Liability Insurance Defense
- Representation of several condominium owners associations in claims of slip and fall, premises defects, and negligent maintenance by tenants and owners. Numerous cases won by summary judgment or favorably settled.
- Representation of child care facility in claims of negligent supervision of child injured on playground. Case favorably settled prior to trial.
- Representation of fabrication shop accused of negligent welding after fire at a lumber yard. Case was favorably settled before trial.
- Representation of electric cooperative in electrocution cases, and several cases involving fires at residences. All electrocution cases favorably settled prior to trial. Case involving single family residence destroyed by fire resulted in jury defense verdict.
Municipal Liability
- Representation of numerous sheriff departments and police departments for cities and counties in southwest Alabama for claims alleging negligent vehicle operation, police brutality, wrongful arrest, jailer liability and negligent training and supervision of police officers. Most cases won through summary judgment or favorably settled after summary judgment pleadings filed.
- Representation of county sheriffs and jailers in pro se actions brought by inmates. All cases resulted in judgment in favor of county and jailers.
- Wrongful death claim against mayor and chief of police of small town for shooting death by off-duty police officer resulted in summary judgment in their favor.
- Representation of several mayors and city counsel in federal cases involving wrongful zoning and land use issues. Cases won on summary judgment or favorable settlement through negotiation and/or mediation.
- Representation of Water and Sewer Board in claims alleging backup of sewage into personal residences. Cases settled or won on motion for summary judgment.
- Represented electric utility in cases involving personal injuries (electrocutions) and property damage (homes destroyed from alleged power surge or electrical equipment malfunction). Defense jury verdict on house burning case.
Surety Bond Work
- Representation of both construction companies and surety companies in construction litigation, working on defaulted projects and litigating claims against subcontractors and other responsible parties.
- Representing surety company on bonds in probate court, executors or administrators have defaulted or improperly taken money, or attorneys have failed to follow through on probating estate. Prosecuted claim against an attorney, heirs, and bank on a Joint Control Agreement.
Employment Related Litigation
- Representation of restaurant chain on EEOC claim and lawsuit alleging age and gender discrimination. Favorable settlement before trial.
- Representation of state agency and supervisor in allegations of sexual harassment and gender discrimination. Favorable settlement after summary judgment filed.
- Representation of hospital administrator and hospital on claims of sexual harassment. Favorable settlement after summary judgment filed.
- Representation of numerous and varied employers in claims of wrongful termination in connection with workers compensation claims.
Flood Litigation
- Representation of Write-Your-Own insurance carriers in major flood cases after hurricanes. Work with FEMA personnel in obtaining flood benefits for insureds and insurers.
- Worked with FEMA Underwriters to rezone major hotel after hurricane had already occurred, resulting in payment by FEMA on claim that had been previously denied.
- Defended insurer on fraud and bad faith claim after denial of flood damage from hurricane. Case settled on the eve of trial for half of plaintiff's alleged damages and reimbursement by FEMA.
