Commercial and Construction Litigation


  • Representation of owner of regional shopping mall in Mississippi sued by subcontractor asserting lien claims.
  • Representation of general contractor in suit for delay damages arising from construction and renovation of city-owned historical building.
  • Representation of marine contractor sued by workers' compensation insurer for retrospective premium; during trial, obtained a $327,000.00 settlement for client on its counter-claim.
  • Representation of shipyard and contractor in claims arising out of the construction of two 16,000 ton chemical tankers owned by Danish shipping company.
  • Representation of marine contractor in claims arising out of construction of tug/barge unit.
  • Representation of owner of office building in claims by and against contractor that supplied and installed new air-conditioning equipment.
  • Representation of general contractor sued by municipality for alleged defects in construction of sewer system and joined in by over 100 residents of municipality who alleged claims for personal injury and property damage.
  • Representation of owner of high-rise office building in claims against general contractor that damaged building while conducting repairs to building envelope.


Product Liability

  • Representation of industrial equipment company in separate lawsuits by two workers injured in collapse of marine scaffolding; settled favorably to client in the face of motions for summary judgment.
  • Representation of hospital sued for implantation of allegedly defective pacemaker. Case was settled with client contributing nothing toward the settlement.
  • Representation of major cookware manufacturer sued for personal injuries as a result of the alleged explosion of its product. Case settled favorably to client in face of motion to dismiss.
  • Representation of national restaurant chain sued for personal injuries allegedly as a result of food-borne illness. Case settled favorably to client in face of motions for summary judgment and to exclude expert testimony.
  • Regional representation of manufacturer of building material in connection with claims by building owners (multiple lawsuits) for damage due to alleged moisture entrapment in walls of building.



First Party Insurance Defense

  • Representation of life insurance company sued for wrongful death of insured under life insurance policy allegedly killed by beneficiary. Received summary judgment in favor of client; affirmed on appeal to Alabama Supreme Court.
  • Representation of life insurance company sued for intentional infliction of emotional distress by mother of insured under life insurance policy allegedly killed by beneficiary. Received summary judgment in favor of client at trial level; intermediate appellate court reversed. After successful petition for certiorari, Alabama Supreme Court reinstated and affirmed trial court's summary judgment.
  • Representation of life insurance company sued in separate actions for fraud by two sisters in connection with alleged misrepresentations of coverage of insured infant with genetic defect. Obtained verdict in first case to go to trial for substantially less than last settlement demand; second case then settled favorably to client prior to trial.
  • Representation of life insurance company sued for fraud and bad faith by husband of deceased insured. After court entered partial summary judgment in client's favor, case was settled on the eve of trial for nuisance value.
  • Representation of life insurance companies in many other lawsuits alleging fraud and bad faith.


Personal Injury Defense

  • Representation of major hotel chain sued for personal injuries by guest. Case settled favorably to client.
  • Representation of general contractor sued for personal injuries by invitee of hospital during construction of major addition to hospital. Case settled favorably to client with third party defendant paying the entire settlement amount.
  • Representation of major U. S. shipping company sued by Jones Act seaman. Claims dismissed during trial on motion for judgment as a matter of law.
  • Representation of major U. S. shipping company sued by longshoreman under § 905(b) of the Longshore and Harbor Workers' Compensation Act. After trial and verdict in favor of longshoreman, judgment notwithstanding the verdict was entered in favor of client.
  • Representation of major U. S. shipping company sued by alleged Jones Act seaman. Obtained jury verdict in favor of client on all claims.
  • Representation of major hotel chain sued by guests claiming damages for fear of AIDS. Summary judgment granted in favor of hotel.
  • Statewide representation of major retail chain in lawsuits alleging premises liability.
