Tracy Turner believes in being very involved and developing personal relationships with his clients. He has litigated in all local state and federal courts, covering such areas as workers' compensation, employment, unemployment, insurance law, forest use law, and local government law, as well as many diverse aspects of personal injury and construction law. He represents forestry clients in insurance defense and general civil litigation. His forestry clients include foresters, timber brokers, timber harvesters, timber buyers and timber haulers.

Tracy also practices workers' compensation and employment law, and represents property managers in evictions, premises' liability, fair housing and fire cases. His experience includes successfully representing insurance companies in fraud and bad faith insurance defense cases.

Tracy's experience also includes the successful representation of various local government entities in employment, civil rights, general liability and workers' compensation matters.

Tracy's client service philosophy is to push for speedy resolutions whenever possible. He's cognizant of the frustration his clients experience when matters are drawn out as well as the high cost of lengthy legal issues. His preferred approach is to intervene early and achieve favorable conclusions. And, Tracy's clients appreciate his efforts and his great communications skills, particularly his excellent listening skills.

When push comes to shove, Tracy is a familiar figure in local and federal courts where he is well known with the judges and court personnel. Having served as a staff attorney immediately upon graduating law school, he developed an in-depth knowledge of the interior workings of the court system. He has known that he wanted to be an attorney since he was eight years old and says the best part is interaction with people and helping them arrive at mutually beneficial results.


Representative Experience

Personal Injury Insurance Defense

  • Represented a commercial vehicle operator in a wrongful death case; received a jury verdict for less than the last settlement offer.
  • Represented an insured logging company in a wrongful death case involving an accident with a log truck; claims favorably settled prior to trial.
  • Represented an insured logging company in an injury case involving an accident by plaintiff's vehicle with a log truck; claims dismissed by summary judgment prior to trial.

Fraud and Bad Faith Insurance Defense

  • Represented an insurance company against claims of fraud and suppression regarding improper sale of fire insurance policies; claims favorably settled during pendency of appeal after the trial court granted summary judgment.
  • Represented an insurance company against numerous claims of fraud, suppression and deceit allegedly committed by agents in sale and service of insurance policies; the claims were favorably settled prior to trial.
  • General Liability Insurance Defense
  • Represented VFW Post in claims of negligence and nuisance receiving a satisfactory jury result.
  • Represented the County Commission and deputy sheriff against state law claims of negligence, wantonness and negligent and wanton training and supervision; the Circuit Court granted motion to dismiss in part and denied in part; a mandamus of Circuit Court requiring dismissal of all claims was granted by the Alabama Supreme Court.
  • Represented numerous insured logging companies in timber overcut litigation; the claims were favorably settled prior to trial.
  • Represented the County Commission in numerous cases alleging flooding damage caused by construction and maintenance of county roads; the claims were either dismissed or favorably settled prior to trial.

Civil Rights and Employment Defense

  • Represented the County Commission against Title VII claims of sex and race discrimination as well as claims of race discrimination under 1981 and 1983; summary judgment was granted by District Court, 954 F. Supp. 1540 (S.D. Ala. 1995) and affirmed by the 11th Circuit, 103 F.3d 148 (11th Cir. 1996).
  • Represented the County Commission against Title VII claims of sex discrimination; summary judgment was granted by the District Court and the case was not appealed.
  • Represented an employer insurance company against Title VII and ADEA claims of age discrimination by a former district manager; summary judgment was granted by the District Court and affirmed by the 11th Circuit.
  • Represented the County Commission against 1983 claim for deprivation of constitutional rights resulting from alleged improper care at the County Jail; summary judgment was granted by the District Court and the case was not appealed.
  • Represented the County Commission and deputy sheriff against state law claims of negligence, wantonness and negligent and wanton training and supervision; the Circuit Court granted a motion to dismiss in part and denied in part; a mandamus of Circuit Court requiring dismissal of all claims was granted by the Alabama Supreme Court.

Represented an agency under the control of the Presiding Circuit Judge against claims of assault and battery and sexual harassment; the claims were favorably settled prior to trial.

Local Government Law

Worker's Compensation

  • Represented the County Commission against a worker's compensation claim by a former employee who was permanently disabled in a wreck involving a county dump truck; the case was favorably settled prior to trial.
  • Represented several claims adjustment companies in numerous workers' compensation litigation matters involving claims of employees for permanent total disability and permanent partial disability benefits.
  • Represented the Alabama Insurance Guaranty Association in worker's compensation litigation assumed by the Alabama Insurance Guaranty Association after the carrier was placed in liquidation by Pennsylvania Insurance Commission.
  • Represented a large grocery store chain against a worker's compensation claim by a former employer seeking permanent disability as a result of an on-the-job accident.
  • Represented a local assisted living facility in a case involving notice issues and disability questions; settled for less than 10% of alleged claims.
  • Represented an international chemical companys local manufacturing facilities in several matters, including two alleged on-the-job back injuries involving notice and degree of disability issues, both were settled for less than 10% of alleged claims.
  • Defense of Mobile County defendant in which surveillance shared with attending orthopaedist caused a restriction modification that reduced damages significantly.

Forest Use Defense

  • Represented a land owner, forester and hunting club in a controlled burning case where smoke from fire allegedly crossed a road; received judgment for the defendants.
  • Represented a forester in controlled burning litigation; the case settled for half of amount of the offer of judgment prior to trial.
  • Representing a land owner, management company, hunting club and the hunting club president in an ongoing personal injury matter regarding allegations that a hazard was placed across Big Escambia Creek and subsequently struck by operator of an air boat.
  • Represented a paper mill landowner and insured hunting club member in an accidental shooting case; the claims were favorably settled prior to trial.
  • Represented an insured timber company in a personal injury matter where a logging crew cut a tree down that fell across the highway, striking a vehicle traveling along the highway; the claims were favorably settled prior to trial.
