Over his career, Chuck Simpson has tried more than 75 civil jury trials to verdict, and has been lead counsel in many civil appeals before the 11th Circuit Court of Appeals and Alabama's appellate courts, including precedent-setting cases involving professional liability, federal regulatory and statutory claims, real property law, and jurisdictional and forum selection issues. He is well known for his work in tort defense, title insurance, bad faith, insurance coverage and real property litigation.

Geographically, Chuck's practice extends throughout Alabama and includes all federal district courts. His clients include major title insurance companies such as Old Republic National Title Insurance Co., Mississippi Valley Title Insurance Co., Commonwealth Land Title Insurance Co., Chicago Title Insurance Co., and North American Title Insurance Co., as well as property and casualty insurers such as Auto-Owners.

Representative Experience

  • Represented a title company insured in a hotly contested sale for the division of commercial property to resolve title defects (sale concluded successfully over objections).
  • Represented a mortgage lender in wrongful foreclosure litigation (summary judgment for defendant; affirmed on appeal).
  • Represented realtors in fraud and breach of contract litigation (defense verdict/directed verdict/mediated settlements).
  • Represented a title company insured regarding the litigated inheritance of waterfront property from the client's deceased parents (resolved in favor of client through advances in DNA testing).
  • Represented a petroleum company in well reclamation and production facility nuisance matters (resolved through trial and settlement favorably to client).
  • Represented commercial entities in litigated state condemnation matters.
  • Represented homeowners in a broad spectrum of personal injury cases.
  • Represented a health maintenance organization in subscriber breach of contract and state bad faith claims (summary judgment based on ERISA for defendant in United States District Court; affirmed by Eleventh Circuit Court of Appeals).
  • Represented a resort managerial employee in sexual harassment litigation (tried with nominal plaintiff verdict).
  • Represented a liquor liability insurer and surplus lines broker in coverage and tort litigation arising out of a death claim (summary judgment for defendants; affirmed on appeal).
  • Represented a bank in consumer lender liability litigation concerning alleged improper repossession practices (tried with defense verdict; affirmed on appeal).
  • Represented insureds in motor vehicle accidents, including death cases.
  • Represented liability insurers on coverage issues.
  • Represented motor vehicle insurers in uninsured/underinsured litigation.
  • Conducted a judicial foreclosure of commercial properties for a major lender (concluded with complete recovery for bank).
  • Represented a utility company in power line contact litigation (settled by nominal contribution).
  • Represented a petroleum company in hydrogen sulfide death litigation (settled within initial authority).
  • Represented a bank in lender liability litigation alleging the misapplication of a letter of credit that supposedly caused a default in an industrial development bond (defense verdict for lender; seven-figure verdict for lender on counterclaim; judicial foreclosure of trust indenture in favor of lender).
  • Represented a financial services company in customer privacy litigation (settled during trial for pre-trial offer).
