Trump Victory Demands Immediate Action on Immigration

While many president-elects make grandiose, undeliverable “Day 1” promises, President-Elect Donald Trump will actually be able to deliver on some of his immigration promises as soon as he steps foot in the oval office. As his overall immigration policy is likely to be much more restrictive than that of President Obama, foreign nationals in the United States need to take immediate action to obtain legal status. For starters, Trump is expected to end the Deferred Action for Childhood Arrivals (DACA) program. DACA was created by Executive Order, as it is the result of the Obama Administration exercising what is known as “prosecutorial discretion.” Essentially, the Obama Administration recognized it had limited resources and certain individuals, such as those brought to the United States as children, should not be high priority deportation targets.  Likewise, it is expected Trump will invalidate or rewrite the U.S. Department of Homeland Security’s November 20, 2014 prosecutorial discretion memorandum that outlined immigration enforcement priorities. The combination of these two events will negatively impact a large number of foreign nationals currently in the United States. If you have any basis for obtaining lawful status, now is the time to act.  Trump does not take office until January 20, 2017, providing a two-month period to prepare for his administration. Moreover, while some actions, like those outlined above, may happen overnight, it will take his administration more time to reallocate the resources necessary to begin aggressively enforcing his policies. To discover your options, call a Johnstone Adams immigration attorney today at (251) 432-7682 or toll-free at (866) 732-3267, or visit our Website.
